2. Legal Undertaking
2.1. By entering a Competition, the entrant will be deemed to have legal capacity to do so, you will have read and understood these Terms and Conditions and you will be bound by them.
2.2. Our Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.
2.3. By registering on Premium Prize Comps and by participating, or entering our competitions, and by accepting these Terms and Conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. Premium Prize Comps and its employees will not be held responsible for any Entrant entering any of our Competitions unlawfully. If you are unsure, please seek legal advice.
1. Who can play
1.1. Users must be aged 16 or over to take part in competitions and age verification may take place prior to any prize being awarded. Failure to do so may result in forfeiture of the prize which shall be retained by the company.
1.2. The User must be resident in Great Britain.
1.3. PPC have the right to close any accounts if it is deemed the account holder is acting in anyway abusive to customers or staff whether it be in person, on site or on social media or if the account holder is deemed to be abusing the site illegally or against in breach of these terms and conditions..
1.4. PPC have right to refuse new account holders or new competition entrants or current competition entrants in its absolute discretion.
1.5. Those who have direct control of either assigning draw numbers / draw methods, or those with direct control of selecting numbers are not permitted to play.
2.1. The users agree that if they win, they are willing to allow PPC to use their name to promote their win on social media and other media forms where seen fit by PPC.
3. Your Payment details
3.1. Your Payment details will not be stored by us, however, will be processed in line with the terms of the payment provider.
4. How to enter
4.1. Each user wishing to take part in a game must
4.1.1. open an account
4.1.2. select a prize
4.1.3. answer the qualifying question
4.1.4. select an amount of tickets. (Where option is available)
4.1.5. proceed to checkout
4.1.6. agree to the Terms and Conditions.
4.1.7. press place order button
4.1.8. complete Paytriot form and press Securely Submit Payment
4.2. The draw numbers (where applicable) will be emailed prior to the draw(s). Where numbers are selected by a random wheel (as provided by wheelofnames.com), this method will be communicated to the entrants in advance of the draw.
4.3. The Maximum amount of draw tickets purchased by one person should not exceed 20% of total paid sales.
5.1. All competitions are subject to fair play.
5.2. Competitions may be repeated for additional items and also for cash amounts. These will be dependent on sales. Where there is more than one draw, they will be held 5 minutes apart.
5.3. Competitions will require a level of sales to trigger the prize being won.
5.4. In the event a competition attracts insufficient sales, or if there is a mechanical reason that prevented sufficient sales
5.4.1. a cash prize may be awarded at 70% of the value of tickets sold. 30% will be retained for tax, administration and promotional costs or
5.4.2. in the case of multiple draws, a combination of Prizes and Cash to the value of 70% of the value tickets sold will be awarded. 30% will be retained for tax, administration and promotional costs or
5.4.3. the entrant’s tickets may be merged with another competition occurring within the next 28 days or
5.4.4. At the sole discretion of the promoter, tickets may be refunded or
5.4.5. The draw can be extended a maximum of two times by two weeks each, and a maximum of 28 days in total
5.4.6. Or any combination of the above
5.5. Where you are asked to select a prize, only one prize will be paid per competition. Where we offer a Multi-Draw, all prizes will be played for under one ticket, with each prize drawn separately increasing players chances of a win.
5.6. Our games offer a free route to play and therefore do not fall within the definition of a lottery under the Gambling Act 2005 and can be operated legally in Great Britain without any need for a licence.
5.7. Discounts are offered for multiple ticket purchases.
5.8. Any orders without completed payments will be void and cannot win a prize (save free competitions)
5.9. There may be a Premium Text number used as entry to competitions, this will constitute payment.
5.10. To the extent permitted by appropriate legal jurisdiction, all funds paid by the entrants become PPCs property and will not be returned other than in the event of complete cancellation (not including cancellations where we play for a cash prize or where tickets are entered into another competition) or permitted requested refund.
6. Forms of Entry
6.1. The prize draws can be entered by paying the online charge via bank transfer and participating in the competition. There is also a free route entry described below.
6.2. Free tickets may be given on social media and via postal route
6.2.1. The social media tickets will be added to the pool of tickets and an overall winner selected.
6.2.2. Free entries may be made by post. One ticket shall be given for each draw as a maximum.
6.2.3. To apply, write the draw and draw date on a plain post card and post to Free Entries at Premium Prize Comps, 4th Floor, Silverstream House, 45 Fitzroy Street, Fitzrovia, London, W1T 6EB.
6.2.4. Free entries must be received 24 hours prior to the draw.
6.2.5. Where there are a selection of prizes, a free entry will automatically win the cheapest prize.
7. Coupons codes and offers
7.1. Coupon codes are valid on competitions as stipulated with the coupon code.
7.2. Where no competition is stipulated on coupon codes, they are valid for all competitions with the exception of those where it is stated on the competition page that no coupon codes are valid or FREE codes are not valid.
7.3. Where a competition states no FREE codes can be used, discount codes can be used, however FREE codes cannot.
8. Selecting a Winner
8.1. A winner will be selected by
8.1.1. Random.org random number selector and this may be performed live on social media when being carried out by the company or
8.1.2. All competitions will be live.
8.2. The company’s decision is final, and no correspondence will be entered into about the result of the Competition following the determination of the winner as described above.
8.3. All entry numbers will be posted on our website.
8.4. All winners will be displayed on the winner’s section of the website.
9. Your account
9.1. You must keep your account password secure and secret at all times and take steps to prevent it from being used without your permission.
9.2. You must
9.2.1. Not share your password with anyone. Not allow someone to use your computer(s) where there is auto log in that will allow unpermitted users including minors to enter competition on your card. In this instance, or one with some of this scenarios characteristics, no refund will be permitted.
9.2.2. never record your password in a way that it can be understood by someone else.
9.2.3. Not leave any evidence of passwords from the company
9.2.4. keep your password or other access information secret,
9.3. You must contact the company as soon as practicably possible if you believe, suspect or know that anyone apart from you has used your account and/or given any instruction in relation to it without your permission, or if you believe someone else knows your password.
9.4. The Promoter shall not be responsible and/or liable for any and/or all consequences arising out of and/or relating to any and/or all breaches of these by you. Furthermore, the company shall not in any event be responsible and/or liable for any actions and/or inactions that you may take and/or consequences that you may suffer and/or incur as a result of using and/or in connection with the Website.
10.1. We may revise our Terms and Conditions from time to time and will post the most current version on the Website as soon as possible after the revised Terms and Conditions become effective.
10.2. Please check this page periodically to ensure you understand the Terms and Conditions that apply at that time.
10.3. By continuing to access and/or use the Website after the revisions come into effect, you agree to be bound by the revised Terms and Conditions. We may also update and change the Website and/or Competitions from time to time to, amongst other things, reflect changes to our offering, Website, IT systems and/or our users’ needs and/or feedback.
11. Unauthorised use and expiry of your debit card
11.1. If you notify your nominated bank (or building society) that your debit card has been used without your permission in relation to a Competition and your nominated bank (or building society) asks the Promoter to return the relevant amount to your nominated bank (or building society) account, the Promoter may suspend your account and ask you to contact the Promoter. The Promoter accepts no responsibility and will have no liability for any chargebacks.
11.2. If your debit card is due to expire, the Promoter will use reasonable efforts to return the funds in your account to your debit card before midnight on the day it expires. If it is not able to do so, the Promoter will use reasonable efforts to alert you of this and you should, in these circumstances, contact the Promoter to arrange another appropriate way for the Promoter to return the funds to you.
12. Right to stop
12.1. The company retain the right to cancel a promotion if there is a reason in its absolute discretion as to why the competition should not continue. In such circumstances, all money paid will be refunded.
13. User Agreement
13.1. These Terms and Conditions are governed by English law and shall be subject to the exclusive jurisdiction of the courts of England and Wales. By purchasing tickets and selecting the Ts&Cs button, you agree That you understand and agree to be bound by these terms.
14. Closing account
14.1. If you wish to close your account, please advise in writing. This will take up to seven days to perform.
15.1. All customers are permitted refunds prior to the competition taking place. An email to us will accommodate this. Any customers attempting refunds after the draw time will be blocked from using the site in the future
16.1. The company will make every effort to contact the customer who has won a prize to confirm delivery. In the event that contact cannot be made, the company will not send the prize. However, in the event that no contact is made within 30 days from the date of the competition, and the winner has failed to contact the company, or the winner has been disqualified for whatever reason, the prize will be forfeited, and no prize given.
16.2. The company will always be as descriptive as possible regarding prizes. On such occasion that the exact match product is unavailable, the company will look to provide a similar product at a similar price. In extreme circumstances, a cash alternative may be offered.
16.3. We provide no insurance or guarantee with any products. Products only come with guarantees supplied by the retailer or manufacturer. It will be your responsibility to address any product concerns, failures, malfunctions or faults of any description with those retailers or manufacturers as appropriate. Under no circumstances can PPC be held responsible for any repairs, replacements or corrections of any nature.
17.1. The delivery of the prizes will be made upon verification of name, age and address.
17.2. Delivery costs are free to any UK mainland destination. Other destinations may incur charges.
17.3. All prizes will be delivered as soon as is practical after acceptance. If for any reason the prize can not be delivered in a reasonable amount of time due to the winner’s inability to accept the prize, the prize will be delivered regardless after a period of 30 days.
17.4. Where prizes cannot be delivered, storage costs or prize forfeiture could apply.
18.1. All Winners will be required to provide photographs or videos, which may be used in the future to market the company and any future competitions. This publicity can be included on social media, press or internet and on the winner page of the website.
18.2. The entrant may also be asked to attend promotional events to promote the company. In this case, all reasonable (and agreed) expenses will be covered.
19. Selecting Products and Game dates
19.1. All the information is laid out in such a way to make it easy for players to select particular prizes and dates. In the event the player makes an error selecting a product, this may be changed to a product of a similar price if reasonably practical. Where the player has chosen an incorrect date, this will be changed if requested in ample time and verified in writing.
20. Data Protection
20.1. Any personal data that you supply to the company or authorise the company to obtain from a third party, for example, a credit card company, will be used by the company to administer the competition and complete prize delivery.
20.2. In order to process, record and use your personal data the company may disclose it to
20.2.1. any credit card company whose name you give;
20.2.2. any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with you;
20.2.3. comply with any legal or regulatory requirement of the company in any country; and
20.2.4. prevent, detect or prosecute fraud and other crime.
20.3. If the company fails and/or delays to enforce a provision of the Terms and Conditions, this failure and/or delay is not a waiver of the company’s right to do so later on.
20.4. If any provision (or part of a provision) of these Terms and Conditions is decided by a court of competent jurisdiction to be void and/or unenforceable, that decision will only affect the particular provision (or part of the provision) and will not, in itself, make the other provisions void or unenforceable.
21.1. The exercise of discretion by the company of any discretion provided for in these Terms and Conditions will be final and binding and will not be used for the benefit of precedent.
22. Charitable Donations
22.1. Premium Prize Comps will contribute to charities of it’s choosing and display these decisions as appropriate in time.
22.2. As of the 15th September 2020 we will donate to Great Ormond Street Hospital Charity.
22.3. The amount of the donation will depend on sales as described below.
22.3.1. 5% of all sales above and beyond the cost of prizes given for each competition will be donated to the charity outlined.
22.3.2. Where there is insufficient sales, and the cost of the prize exceeds the sales value for that competition, no donations will be made.
23.1. Trustpilot has access to email addresses on Premium Prize Comps to allow them to send emails directly to the users to give the option to score Premium Prize Comps on Trustpilot.
23.2. Your information is not accessible through Trustpilot to any other parties.
